If someone was convicted of 5 felonies for an incident, and theyve been sentenced to probation and about 3 years has passed, is there anyway to take the case back to trial or something, and persue attempted manslaughter? Im in NYS, I'd appreciate anyone's feedback. It was 3 years ago, like I said and the court preceedings are all over. I know there's no double-jeopardy in this country but is there some re-assessment of the case that can take place? The police have a machete used in the incident in their possession and a lot of other evidence documented. I have no idea how this guy didn't go to prison, I'm really fucking baffled but I think he ought to.

Double jeopardy wouldn't apply to a manslaughter charge if it concerned actions or elements not covered by the previous convictions. If that's too theoretical for you, if there the convictions included things like felony assault and there's no new evidence, the prosecution is done.

Whenever someone is a asked a question in court that would reveal his guiltiness, he may answer: "I refuse to answer on the grounds that it may incriminate me".
Isnt that enought to convict him? Granted, he may not lie in court. If he said "no" and later found out it was a lie, he gets punished.
if in his inability to lie in court, the only substitute for "yes" in say "did you murder Mr. X?" is "I refuse to answer because it may incriminate me", isnt that enough to indirectly know he's already guilty?
am I insane to believe this? What am I missing?

Opinion: I don't believe that would be allowed in a court of law. The state, the people, need to prove beyond a reasonable doubt that circumstances, evidence, witnesses shows defendant is guilty beyond a reasonable
doubt. Not all law requires this.

The idea of 'might incriminate ones-self' goes along with the right to not be compelled to self-incrimination.
So not answering a question(s) in court or statements to police puts the burden of proof to police and
subsequently prosecution to provide enough evidence to pursue, win a conviction in a case.
This relies on ((burden of proof,) on the part of the prosecution.

In short not testifying or refusing to make statements and answer questions is a right in due process of law.
Which refusing to do so does or should not show guilt. The burden it on the state to prove it's case, not the
defendant.

Guys fuck I got arrested and the judge released me on bail and said I have court on the tenth today at 730.

The other day I got a letter from the attorney office from the lawyer they appointed to me. It says the next scheduled court date is the 17th at 730

Fuck they both say 730 so its weird. The letter says not to call the court but call the lawyer office. I don't have time on my phone so the only way I can call is at 5 when my mom is done work.

Should I go tonight or call or what? I was arrested 4 days ago and got the letter 2 days ago. I haven't even had a chance to call the lawyer yet. Is there two court dates I have or is someone wrong or did it get rescheduled?

Can anybody here verify if this is something legit that will actually play out safely if I choose to sign up and give them information necessary to redeem checks or if there is a cleverly worded snake in the grass there that'll end up biting me down the road somewhere? I've seen videos of people redeeming checks in the hundreds of dollars range. It seems really neat and I really want to jump on the Tsū train if I can pay important bills/rent/buy food because I'm poor as fuck, but it hasn't been around long enough for me to be comfortable using it without being absolutely sure that I'm not gonna have problems after years of use. tl;dr i was walking out of a grocery store and i was struck by a train of carts being pushed by a cart handler.

i just had a sitdown face to face with the grocery stores adjuster. it was kind of weird. he made some claims that " i said" that i NEVER said and also said he reviewed the footage of the incident and "it looks like i didnt get hit, but he really couldnt tell"

i asked if i could see the footage and he told me that even with a lawyer i would never see that footage. (a cursory search of the internet tells me this is a lie)

ive just been dealing with them by myself. i have fibromyalgia so i pretty much live in a world of pain but getting struck (at a casual pace) by shopping carts sprained my back muscles and as a graphic designer i had to submit a project late because i couldnt work at a computer for long periods of time for a week or so after the accident, my client understood but professionally i feel pretty shitty about it. i missed out on other projects from my regular employer during that week because i was laid out.

should i lawyer up? he straight up asked me if i was lying about being hit by the carts and i told him 100% those carts touched me, i didnt jump out of the way, any movement of me around the carts was me being pushed by them

halp i dont want my medical bills to go unpaid. i know they will offer me a pittance but it feels like they are trying to call me out on faking

get a lawyer, ten to 1 that footage shows exactly what you need to get your bills paid. many lawyers offer free consolations explain you especially whant to see the footage and that it does exist.
the big thing with medical settlements is you want them open ended. if in 3 years you have problems that are related to this you dont want to have reached a settlement that closed out getting any more money that you deserve.

2 years ago? I applied for ssi for some physical and mental stress I was going through l, but never completed it. and there's no paperwork or doctors reviews, and I missed appointments, got denied. and they never really got anything out of it besides helping me with general assistance.

But that was for the check they caught me fore, and I had told ,y lawyer eveeything, including the 7 other checks they had me try and fail to cash that day

I don't need your advice as much as my friend does. Yesterday at !:00pm, my good friend was arrested at a road block. I drove through the same checkpoint 30 minutes later on my way to meet him to leave for a concert. When I drove through I saw his car parked on the side of the road with no one inside, I knew exactly what had happened. He rolled up on the cops while smoking a blunt, but threw it out the window. They smelled the weed (of course), and searched the car. He was most concerned about wether or not he had his jar of weed with him, which probably had an ounce of pot in it. Much to his surprise, the cops pulled out a meth pipe he thought he got out. Also they found a small amount of weed, and an empty bag that had some residue in it. Luckily I was bringing my acid and he didn't have his vial on him, also they didn't find the roll he had

So they take him to jail and grill him. He says he had no idea that the chicken was in there, and it isn't his. The cops say they want him to find the person that it belonged to and tell them to admit it.
They charge him for simple possession of weed, and held off on the charges for the pipe and bag until he proves it wasn't his. Luckily its a very small town and his parents are very prominent and connected in the county. They are church goers, and own a very successful business owners. Also they are fairly wealthy so he can get a good lawyer. These are very good things but how much will it help him for such a feared drug. Also he has never had a prior drug charge, and only one drinking charge years ago. His court date is in late December and he will be graduating engineering school a few days before. I think this will also look very good. However the next county over, mine, just busted 60 people for dope last week, the result of a two year investigation. So they either got their bellies full, or have a hard dick about it.
My questions are:
Will they charge him for literally like 10mg of dust in a bag?
What kind of punishment would he receive for the pipe?
He is thinking of entering a rehab program on his own will, will thi…

I can't read the minds of the cops that are holding your friend, but generally speaking police/prosecuting attorneys tend to have one or two particular, 'big' charges that they want to get convictions on and they will shotgun other, lesser charges and then offer to drop those lesser charges if the suspect will plead guilty to the big one(s).

They're trying to play him. Even if he could prove it wasn't his (and how the fuck could he do that?) the police are under no obligation to share exculpatory evidence (evidence that proves innocence) in court. It's irrelevent anyway because the burden is on them to prove that it belongs to him. I don't know how damning it is that they found it in the car. Maybe someone else can speak to that.

Is there anything that can legally be done to someone for shitting all over the floor in a public bathroom?
I work in fast food and today some old lady shit all over the place. It was smeared all over the seat, the underside of the bowl, and all over the floor around the toilet. I got stuck cleaning it up. I initially flat out refused but was threatened with a write up so I just grabbed the mop and cleaned the whole thing up with that.

Anyway, this isn't even the first time that lady's done it. I don't know if it's because she's old and doesn't know wtf she's doing or what. She goes in with her daughter though, I don't think she drives herself.
This has gotta be illegal right? I mean you're basically creating a giant biohazard.
I'm just a grunt, not a manager or anything. This is in Oregon by the way.

So /law/ today I got a a letter from the DMV(CA) that the action that has been taken against my license(being suspended) due to the DUI charge I got a couple months ago has been set aside. In other words the charge was BS and my license is still valid.

Combine this with the fact that after i missed my arraignment date, I called warrants division to confirm I had a bench warrant out for a failure to appear, but i didn't... Which now would seem to make sense if I wasn't on the docket because the DA dropped the charges, with this letter i received today being the clue for me to connect the dots.

I won't know till i call warrants again tommorow, but considering I had 0 alcohol in me, passed every test and the only thing in my blood when they took it being THC metabolites(this is california remember), I'm willing to bet the DA dropped the charges.

So hooray for me, but know celebrating till i know for sure.

What do you think /law/?

Basically my ex-gf was working at a dog grooming place for a few months. To make this short she went to the hospital and received a 3 day doctors/nurses note. Well comes that 3 days and her employer tried telling her there's "two" types of doctors and nurses notes. Uh, no. A nurse note is the same as a doctor. THEN she requested her medical references to come to work so she knew what had happened...under law, if you're not a doctor you have no use for that information.

Now, here's the twist...I found out from my neighbor last night they didn't send her final partial payment because I called her work for her to speak up to her boss which got her fired. That's fine, never said anything threatening or harassing just "I got off the phone with Swedish medical center and they told me there's no such thing as two different types of notes." Which lead to her getting nasty asking if I ever had a job? Uh, yes was my response but I've never had to work for anyone like you. So, now that she has declined a doctors note and asked for personal medical information to return to work...she supposedly decided not to give my EX her final partial check because she was upset WITH ME! And you know how I found this out? My neighbor, meaning she's going around telling people. They "laughed" at the fact she was gone not even knowing why she was in the hospital. Now, i'm waiting for to call to confirm that this is true but no one makes that up especially when we had been waiting on a small check. It's not about the money but making sure this lady gets the punishment she deserves if this is true. If it is should I call the police for not paying her or should I go through a lawyer? I'm 24 now and have never experienced abuse like this in my life. It's a small dog grooming business so they really don't have the money to afford a lawsuit. Am I crazy or do I have a solid case if this whole non-payment is confirmed because she was "angry at me" because I spoke up to her boss saying she won't be working there anymore. I yelled into that bitch he was a chomo and god knows what happened aftter that. Prob nothing considering it's TN....they're used to meth head child molesters. I swear he looked like Einstein his eyes look closed in the mugshot but fuck that chomo was in there up for the full 4 days..I had a piece of a metal bar I found during private showers. Wrapped It up in a Styrofoam cup I had to ask for 5-6 banging on the cell door. Sad part I left it on the bench too excited I got bonded out..

A few months ago i started putting payments toward a truck off of craigslist. The meeting went fine and i have signed receipts for payments so far. Last week, however, i was in an accident that left me without wheels or income. After calling to explain that the sale has to be cancelled, he tells me he doesnt have my money, and that id have to wait till he resold the truck to get it. Im at a bit of a loss as to what i should do about this.
