So here's how it is...

I got caught breaking into some cars and in my state, NV, that is a burglary and a felony. So the official charges break down to 4 burglary felonies, 2 damage to property misdemeanors, and one unlawful possession of a debit card gross misdemeanor.

Now I can't in any way afford a high powered attorney and my public defender isn't too enthusiastic about fighting my case.

The current offer is plea no contest to one felony and the gross misdemeanor and the DA won't oppose diversion court and Ill pay restitution and do probation but have a felony on my record.

The original plea offer was plea no contest to one felony and pay restitution and do probation with no mention of diversion court.

One lawyer I spoke to said I have a good case to just argue for diversion court after taking the original plea offer and that sounds good to me cuz I want to keep my record clean in the long run but my appointed attorney said once a new deal is on the table the old one is now unavailable.

Does anyone know anything about this? What do you guys think I should do?

Yea, basically that is what it is after an agreement. Keep meeting with the DA,
just might happen to avoid a felony conviction on your record.

See what kind of better agreement you could possibly get. A weight the pros and cons.

Here's an update cuz fuck it why not.

I completed a halfway house program in a new city and am living on my own now. I've passed a few drug tests and have been being a good boy so to speak.

My final lawyer meeting is Thursday and after that it's court. I'll most likely have to do a few years of probation and hopefully drug court diversion to get the felonies off my record.

I miss smoking weed so much I can't wait, jk I will, until I can again legally

He might mean just taking your guilty plea to the judge requesting diversion instead of doing a deal with the DA. Good or bad moving depending on the judge.

Lol jk still paranoid from the ridiculous amount of drugs I've done.

All's been good and well. I had my arraignment where I guess I successfully please guilty to one count of felony burglary and will argue for diversion against the DA. Even tho I remember almost nothing of this thanks to xans or h... Or both.. idk whatever my lawyer said I did really well.

My sentencing is in a tad over two months and I'm optimistic, even tho my car was stolen and I wanna cap the fucker.. I will refrain...

Optimistic since I still look like a boy scout on paper. Wish me luck on my sentencing in March I will keep u all updated even if it's after a few weeks in jail and\or prison.

I AM a shitty burglar, but my thieving was never pinned on me, rather various roommates or unknowns and I didn't care cus, ya.. heroin, dlod, opana, etc......

And burglary in Nevada is harsh af I'd be looking at 1-3 years probation in almost any other state

NV doesnt fuck around anymore ever since people have been coming over here from cali they have been hitting everyone with fucked up shit. which I understand this is a cowboy state and they have a "you want to be a criminal? wrong state fucker!" mentality. the east side of the state is the worst part because they arent used to seeing some of the shit that they have been seeing. I'm from washoe county and got caught up on the east side of my state and caught a felony and went to the pen for some shit that would have been a gross misdemeanor if I got caught at home.

I didn't go to the pen just county. I popped dirty for alcohol heroin adderal subs ghb klonipin and xanax and phenobarbital. ya my judge was not happy...

Anyways I went to jail for 2 months, argued for diversion and got it. Then I had to go to the salvation army and that shit suckedddddddddddd

Only place that accepts violent offenders so the atmosphere was really something else for a hippy dude like me to get used to.

I completed the program with a 30 day extension cuz they fuckin hated me cuz I am not a christian but I finished it and moved back home.

Now I have a decent job and I should be able to get an early graduation from drug court and probation because I have had a perfect program since I was sentenced.

All in all I feel I did good for facing 4 4-10 years and whatever the misdemeanors would have added to it.

still can't wait to smoke again.

Me and my PO are on good terms. I talk to her about once or twice a month.

Last time she came by my house I was actually out at an AA meeting and I guess she told my mom that she isn't worried about me and just checking the place as a formality.

And the best I can hope for with my court program is an early graduation in August. It would be tight if the judge in a few weeks said "oh ya your actually a baller so we r just gonna let u go free" but I highly doubt it

Wow, time sure passes. An interesting story an associate was caught with cocaine, I believe. The guy told the judge he was joining the military soon. As he just was set on going to a positive direction in life. The judge dropped everything and was pleased about his decision to better his future. A mere two weeks later, he was in front of the judge for the same thing. Assiciate sais the judges face turned very red and he said, you, again. He queried if he had even tried to join the military. Not a good situation.

I had another good check in with the court 2 days ago. They told me to pay off my fines and I would be done, and then they went ahead and waived $1,400.00 off my fines.

Here's hoping that by the end of next month I will be a free man!!
